Volvo Sued in Tractor Trailer Crash

The Law Offices of Frank L. Branson has filed a negligence and products liability lawsuit against Volvo Group North America Inc and Volvo Trucks North America on behalf of a man from Arlington, Texas, who suffered severe injuries in a crash involving a tractor-trailer manufactured by Volvo.

The lawsuit filed on Nov. 2, 2009, includes claims that design flaws in the Volvo tractor-trailer played a role in the crash that occurred on Nov. 18, 2007, in Montague County, Texas. According to the lawsuit, a defective rear axle in the 2005 Volvo tractor-trailer caused the driver to lose control before the vehicle rolled over and crashed into a ditch. The injured man was resting in the truck’s sleeper at the time of the crash. Even though he was properly restrained inside the truck, the man was thrown from the vehicle and suffered serious, permanent and disabling injuries.

The lawsuit was filed in the U.S. District Court for the Northern District of Texas, Wichita Falls Division. The Law Offices of Frank L. Branson has a long history of handling cases where individuals have been seriously injured or killed in incidents involving tractor-trailers and other heavy trucks. The firm represented the families of three individuals who were among 23 elderly nursing home residents who died in a bus fire in 2005 while fleeing from Hurricane Rita. The $80 million settlement for the families of all 23 victims ranks as one of the largest settlements of 2009 involving a single-vehicle incident.
